1. DEFINITIONS
In these Terms, the following definitions apply:

“The CTRL”, “we”, “us”, or “our” means the Pilates studio trading under that name.

“Studio” refers to the physical premises operated by The CTRL, located at First Floor, Unit 3 Old Court Mews, 311A Chase Road, London N14 6JS.

“User” means any individual who accesses or uses the Website and is 18 years of age or older.

“Member” refers to any individual who completes the Account Activation Process and is accepted by The CTRL, thereby gaining access to services and facilities provided under these Terms.

“Terms” means these Terms and Conditions, which govern the use of The CTRL’s services and Website.

“Website” means www.ctrlcollective.co.uk and any associated sub-domains unless expressly excluded by their own terms.

“Class” means a group reformer Pilates session offered by The CTRL.
-
“Private Session” means a one-to-one reformer Pilates session with an instructor.
-
“Semi-Private Session” means a session delivered to a small number of Members (fewer than a Class but more than one individual).

“Workshop” means a one-off or short-term programme delivered by The CTRL on a specific topic.
1.1 References to the singular include the plural, and vice versa. References to one gender include all genders, as applicable.
1.2 These Terms, together with The CTRL’s Privacy Policy, form the entire agreement between The CTRL and any User or Member in relation to access to the Website and use of the Studio’s services. No other terms shall apply unless agreed in writing.
1.3 If any provision of these Terms is found to be unlawful or unenforceable by a court or relevant authority, that provision shall be removed to the extent required, but all other terms shall remain in full force and effect.
1.4 The CTRL may update or revise these Terms at any time if necessary for legal, regulatory, or operational reasons. Any changes will be made available to Members and shall apply from the stated effective date. Continued use of the Website or Studio services after such updates constitutes acceptance of the revised Terms.
1.5 These Terms are governed by the laws of England and Wales. Any dispute arising in connection with them shall be subject to the exclusive jurisdiction of the English courts.
GENERAL: USE OF STUDIO
2. MEMBERSHIP
2.1 Account Activation
An individual may apply for membership by creating a membership account via The CTRL’s Website or booking app (the “Account Activation Process”).
2.2 Agreement to Terms
By creating a membership account, the applicant confirms that they have read, understood and agreed to be bound by these Terms.
2.3 Acceptance of Membership
Acceptance of a new Member is at the sole discretion of The CTRL and may be declined without explanation.
2.4 Termination or Suspension
The CTRL reserves the right to suspend, revoke or decline to renew a membership if the Member’s conduct is, in The CTRL’s reasonable opinion, disruptive, inappropriate, in breach of these Terms, or negatively affects the wellbeing or experience of others. No refunds will be issued for any remaining membership period if terminated under this clause.
2.5 Guest Participation
Guests must complete the full Account Activation Process and be accepted as a Member before participating in any sessions.
2.6 Age Requirement
Membership is only available to individuals aged 18 or over.
3. BOOKING, CANCELLATIONS & AMENDMENTS
3.1 Booking Platform Access
Members may book or amend their own sessions exclusively through their personal booking account via the Gym flow platform, accessible either through the website or the app.
3.2 Daily Booking Limit
Each Member is permitted to book one in-studio class per day.
3.3 Cancellation Windows and Charges
For group classes, cancellations or reschedules must be made at least 12 hours before the scheduled start time. For Private Sessions and Workshops, a minimum of 24 hours’ notice is required. All cancellations must be made through the Gym flow platform. Verbal, handwritten, or last-minute cancellations delivered in person will not be accepted unless expressly acknowledged by a Studio team member.
If a Member fails to cancel within the required notice period, or does not attend a booked session, the session will be treated as used and the credit will be deducted from their account. This applies to all Members, including those on class packs, recurring memberships, or any introductory offers.
This includes any instance where a Member is automatically added to a class via the waitlist system, including SMS or app enrolments. Normal cancellation rules and charges apply once a Member is confirmed into a class from the waitlist.
For health, safety and session quality reasons, Members must arrive no later than the scheduled start time. Entry will not be permitted once the class begins, and any missed session will be treated as a no-show with the credit deducted accordingly. We recommend arriving at least 5–10 minutes early to allow time to check in and prepare.
3.4 Session Validity and Expiry
All sessions are valid from the date of purchase and must be used within the expiry period stated at the time of booking or as set out in the relevant membership or class pack terms. Sessions are strictly non-refundable, non-transferable, and may not be exchanged for credit or cash, except where otherwise required by law or expressly stated in these Terms.
3.5 Automated Notifications
The CTRL may, at its discretion, send automated reminders or booking confirmations via email, SMS, or push notification through the booking platform. These notifications are provided as a courtesy only. It remains the Member’s sole responsibility to manage their bookings and cancellations in accordance with these Terms, regardless of whether such notifications are received or viewed.
3.6 Waitlist Notifications and Auto-Enrolment
If a class is full, Members with valid credits may join the waitlist. Credits are not deducted at this point. When a space becomes available, the system automatically adds the next person in line, provided they still have enough credits. Once enrolled, your credit is deducted and the booking is subject to our usual cancellation and no-show policy.
Auto-enrolment runs up to 1 hour before class. After that, you will not be added automatically, but we may still offer last-minute spots manually if credits are available.
It’s your responsibility to monitor your waitlist status. If you no longer want the spot, remove yourself from the waitlist or cancel the booking within the cancellation window.
3.7 Attendance and No-Show Tracking
The CTRL reserves the right to monitor Member attendance and track no-shows. Repeated late cancellations or non-attendance may result in additional fees, booking restrictions, or suspension of access to the Studio’s services. The CTRL will determine thresholds and enforcement actions at its sole discretion and may notify Members accordingly.
3.8 Access to Booking History
Members may access their own booking and attendance history at any time via their Gym flow account. This includes upcoming bookings, past attendance records, cancellations, and any associated charges or penalties.
It is the Member’s responsibility to review their booking history regularly and ensure its accuracy. Any discrepancies must be reported to us in writing within 7 days of the relevant session date. The CTRL is not obliged to investigate or amend any issues raised outside of this timeframe.
3.9 First-Come, First-Served Access
All sessions are made available to Members on a first-come, first-served basis. The CTRL does not guarantee access to specific time slots, instructors, or class formats. Members are encouraged to book early to secure their preferred sessions.
4. PAYMENT TERMS
4.1 Pricing Information
Current pricing for sessions, class packs, memberships, and gift certificates is published via the Gym flow platform and may also be made available upon request at the Studio. All pricing is set by us and may be updated at its sole discretion.
4.2 Payment Requirement
No Member shall be permitted to attend a session unless the applicable fee has been paid in full and a valid booking has been confirmed through the Gym flow system.
4.3 Refund Policy
All payments made for sessions, class packs, memberships, and gift certificates are non refundable, except where expressly stated otherwise in these Terms or where required by law.
4.4 Gift Certificate Use
Gift certificates may only be purchased for and redeemed by individuals who are registered Members of the Studio.
4.5 Membership Auto-Renewal
Where a Member subscribes to a recurring membership, the membership will renew automatically at the end of each billing cycle unless cancelled in accordance with these Terms. By purchasing a recurring plan, the Member authorises The CTRL (or its third-party payment processor) to charge the applicable fee to the payment method on file at the start of each renewal period.
4.6 Failed Payments and Payment Issues
If a scheduled payment is declined, rejected, or otherwise fails to process, we may temporarily suspend the Member’s access to booking and studio services until the outstanding balance is settled. The CTRL reserve the right to apply an administrative charge of up to £10 per failed transaction, particularly in cases of repeated failed payments or dishonoured direct debits.
4.7 Expiry of Class Packs and Gift Certificates
All class packs and gift certificates are subject to expiry. The validity period will be stated at the time of purchase. Unused sessions or certificates will expire at the end of the relevant period and will not be extended or refunded unless otherwise required by law.
4.8 VAT and Currency
All prices are listed in pounds sterling (GBP) and include VAT where applicable. We reserve the right to adjust pricing to reflect changes in VAT rates or other applicable taxes or regulatory charges.
5. STUDIO OPENING TIMES
5.1 Session Timetables and Availability
Session schedules, including class times and availability, are subject to change at the discretion of The CTRL. The most up-to-date session times will be published via the Gym flow platform and may also be displayed at the Studio premises. It is the Member’s responsibility to check the current schedule before making a booking.
5.2 Public Holidays
The Studio may operate a reduced schedule, modified timetable, or close entirely on public holidays. Any changes to standard opening hours will be communicated in advance via the Gym flow platform or by email where reasonably practicable.
5.3 Scheduled Maintenance or Staff Training
We reserve the right to temporarily close the Studio, or reduce access to certain services or equipment, to allow for scheduled maintenance, deep cleaning, upgrades, or staff training. Where possible, notice of such closures will be provided at least 48 hours in advance.
5.4 Emergency Closures and Unforeseen Events
In the event of an emergency or circumstances beyond The CTRL’s reasonable control, including, but not limited to, extreme weather, power outages, building damage, or health-related restrictions, the Studio may be closed or sessions cancelled without prior notice. The CTRL will make reasonable efforts to notify Members of such disruptions and to resume normal operations as soon as practicable.
5.5 Notification of Changes
Any updates to opening hours, class schedules, or temporary closures will be communicated through the Gym flow platform and may also be posted at the Studio or sent via email or SMS. It remains the Member’s responsibility to check for updates before attending a session.
6. MEMBERSHIPS AND CLASS PACKS
6.1 Welcome Offer
New clients are eligible for a one-time introductory offer of 3 in-studio sessions, valid for use within 1 month of purchase. This offer is non-renewable, non-transferable, and intended strictly for first-time clients only. Standard booking and cancellation policies apply.
If a client purchases more than one Welcome Offer, whether intentionally or in error, the additional package(s) will be invalid, and we reserve the right to cancel the duplicate and issue a refund. Repeated misuse may result in suspension of access to Studio services.
6.2 Recurring Monthly Memberships
The Studio offers monthly recurring memberships that provide a set number of sessions per billing cycle. All memberships are subject to a minimum commitment of three months, after which they continue on a rolling monthly basis unless cancelled.

Memberships do not include rollovers. Unused sessions expire at the end of each billing cycle.
6.3 Class Packs
Class packs provide flexible access to a fixed number of sessions, each with a specific validity period from the date of purchase:

10-Class Pack – valid for 4 months

20-Class Pack – valid for 6 months
Class packs do not renew automatically. Sessions not used within the stated validity period will expire and cannot be reinstated. Packs are non-transferable and non-refundable.
6.4 Introductory Offers
Introductory offers may be made available at The CTRL’s discretion and are subject to separate terms stated at the point of purchase. These offers are non-transferable, non-renewable, and may be withdrawn at any time.
6.5 Non-Transferability
All memberships, class packs, and associated session credits are personal to the Member and may not be shared, transferred, sold, or gifted to another individual under any circumstances.
6.6 Suspension and Freeze Policy
The CTRL does not currently offer suspension or freeze options for any membership or class pack product. Exceptions will not be made for holidays, illness, or travel, unless otherwise required by law.
6.7 Waitlist Automation and Booking Window
When a session is full, Members may join the waitlist. If a space becomes available, the Gym flow system will automatically book the next Member in the queue into the class, provided they have a valid session credit. This automation runs up to 1 hour before the scheduled start time. After that point, bookings must be made manually by Studio staff. It remains the Member’s responsibility to monitor their class bookings and manage any resulting attendance or cancellations.
6.8 Cancellation by the Member
Members may cancel a recurring membership at any time after the minimum 3-month term by providing notice via their Gym flow account or in writing to The CTRL. Cancellations must be made before the next billing date to avoid further charges. No refunds will be issued for unused sessions within an active billing period.
6.9 Changes to Membership Type
Members may request to upgrade or downgrade their membership plan directly through the booking app. A minimum of one full billing period’s notice is required for any changes to take effect. All changes are subject to availability and will apply from the start of the next billing cycle. Class packs are non-convertible and may not be applied toward membership payments.
7. MEMBERSHIP BILLING AND CHARGES
7.1 Billing Cycle
Memberships are billed on the date of initial purchase and automatically renew on the same calendar date each month. A minimum commitment of three consecutive billing cycles applies. After this period, the membership continues on a monthly rolling basis until cancelled in accordance with these Terms.
7.2 Cancellation Timing and Effect
If a Member cancels their membership, the cancellation will take effect at the end of the current billing cycle. No refunds or partial refunds will be issued for any remaining days within that billing period. The Member will continue to have access to all membership benefits until the cancellation becomes effective.
7.3 Credit Allocation and Reset
Session credits are issued on each billing date and are valid for use within that billing cycle. Unused credits do not roll over. Booking access will be restricted if a Member exceeds their monthly credit allowance.
7.4 Cooling-Off Period (Online Purchases)
Where a membership is purchased online or outside the Studio, Members have a statutory right to cancel within 14 days of purchase and receive a full refund, provided no sessions have been attended or booked. By purchasing a membership, the Member agrees to immediate access and acknowledges that the 14-day cancellation right is waived once service usage begins.
7.5 No Refunds Outside Cooling-Off Period
Outside of the statutory 14-day period, all membership payments are non-refundable. This includes situations where a Member does not attend or book sessions within the billing period.
7.6 Late Cancellation and No-Show Charges
All late cancellations (within 12 hours of a scheduled class) and no-shows, including those resulting from automatic waitlist enrolment, will result in the session being deducted from the Member’s account. No additional fees apply.
8. FITNESS AND HEALTH
8.1 Member Responsibility
By agreeing to these Terms, all Members confirm that they are in suitable physical condition to participate in Reformer-based Pilates sessions and that they have disclosed any medical conditions, injuries, or health concerns that could affect their participation. This includes (but is not limited to) cardiac conditions, respiratory issues, joint or spinal injuries, neurological disorders, or any condition requiring ongoing medical treatment.
8.2 Ongoing Disclosure
It is the responsibility of each Member to update the Studio on any changes in their health status that may arise after joining, including any new injuries, surgeries, illnesses, or symptoms that may impact their ability to safely participate in sessions.
8.3 Medical Clearance
Members are strongly advised to seek medical advice before beginning or continuing exercise if they are unsure about their current health or have any diagnosed condition. Participation is at the Member’s own risk, and the Studio reserves the right to request a medical clearance note where appropriate.
8.4 Instructor Guidance and Safety
All Members must follow the instructions of their teacher at all times during sessions. Teachers are not qualified medical professionals and will not diagnose or treat any condition. The Studio may refuse participation or restrict activity at its discretion if it believes a Member’s health may be at risk.
8.5 Alcohol, Drugs, and Supervision
Members may not participate in any session while under the influence of alcohol or drugs. Studio equipment may not be used outside of supervised sessions under any circumstances.
8.6 Incident Reporting
Any accident, injury, or adverse health event that occurs on Studio premises must be reported to a staff member immediately.
8.7 Medical Clearance and Assumed Risk
By participating in any session at the Studio, the Member confirms they have obtained, or have voluntarily chosen not to obtain, appropriate medical clearance to undertake physical activity. The Member accepts full responsibility for ensuring their own readiness to participate and waives any claim against The CTRL arising from a failure to seek medical advice. The CTRL disclaims all liability for any injury or complication resulting from a Member’s participation, except where caused by negligence.
9. PREGNANCY (PRE & POSTNATAL)
9.1 Participation During and After Pregnancy
The Studio does not permit participation in any Class, Workshop, or Semi-Private Session during pregnancy, regardless of stage. This policy is in place for safety and liability reasons. However, Private Sessions may be offered during pregnancy where:

The Member has received clearance from a GP or midwife to exercise, and

The Member has completed The CTRL Liability Waiver, which confirms acceptance of risk.
Postnatal participation is only permitted for Members who have been medically cleared to return to physical activity. By agreeing to these Terms and completing the Studio waiver, Members confirm that they have received such clearance and are fit to participate. The CTRL does not require written evidence but relies on the Member’s declaration as binding.
9.2 Medical Responsibility
It is the Member’s sole responsibility to assess their readiness for pre- or postnatal exercise. Members who participate in any exercise program while pregnant, or immediately following pregnancy, acknowledge that they may increase the risk of injury to themselves and, if applicable, to their unborn child. Members personally accept any and all risks associated with participating in exercise at the Studio. Studio instructors are not medical professionals and cannot provide advice on medical suitability. Members must stop immediately if they experience any discomfort and seek appropriate medical guidance before continuing.
9.3 Studio Liability
By choosing to participate prenatally or postnatally, the Member accepts full responsibility for their own health and safety. The CTRL accepts no liability for injury, illness, or complication arising from prenatal or postnatal participation unless caused by The CTRL’s negligence. Members agree to release The CTRL and its staff from any such claims, to the fullest extent permitted by law.
Members further agree to indemnify and hold harmless The CTRL, its directors, officers, employees, contractors, and instructors against any claims, costs, or expenses (including legal fees) arising from their prenatal or postnatal participation, except where caused by The CTRL’s negligence.
9.4 Confidentiality
Any health-related information shared with the Studio regarding pregnancy or postnatal status will be treated in confidence and handled in accordance with data protection legislation.
10. LIMITATION OF LIABILITY
10.1 Session & Facility Availability
The CTRL does not guarantee the availability of any specific session, instructor, class type, or equipment at any given time. The CTRL reserves the right to modify or withdraw sessions, teachers, or Studio facilities (including changing areas, restrooms, and other amenities) without notice. The CTRL is not liable for any resulting loss, except where such liability cannot be excluded by law.
10.2 Health Risks and Personal Responsibility
Each Member is responsible for ensuring they are fit to participate in Studio sessions. All participation is voluntary and undertaken at the Member’s own risk. The CTRL accepts no liability for any health issue or injury arising from participation, except where caused by The CTRL’s negligence. Studio staff are not medical professionals and any guidance provided does not constitute medical advice.
10.3 Loss, Damage, and Injury
The CTRL does not accept any liability for loss or damage to personal property, or for any injury sustained on the Studio premises or in connection with participation in its services, except where such liability cannot legally be excluded under English law.
10.4 General Waiver
By attending sessions and using Studio facilities, Members voluntarily accept all related risks and release The CTRL from liability, except in cases of death or personal injury caused by The CTRL’s negligence.
10.5 COVID-19 Assumption of Risk
Members acknowledge that despite The CTRL’s adherence to government guidelines and safety measures, the risk of exposure to COVID-19 cannot be eliminated. By entering the Studio, Members voluntarily assume all risks associated with exposure to COVID-19. The CTRL is not liable for any related loss or injury, unless such liability cannot be excluded by law.
11. USE OF FACILITIES
11.1 Facility Access
The Studio may temporarily withdraw access to facilities at any time without notice, including for maintenance, repairs, cleaning, health and safety reasons, or any other operational need.
11.2 Children and Minors
Access to the Studio, including all classes, private sessions, and events, is strictly limited to individuals aged 18 and over. The CTRL does not permit entry to anyone under the age of 18 under any circumstances.
11.3 Use of Studio Property
Any products or amenities made available at the Studio are for on-site use only. Removal of Studio property without authorisation may result in termination of membership and legal action.
11.4 Mobile Phones and Photography
Mobile phones must be kept on silent during classes. No photos or videos may be taken of the Studio, instructors, or other Members without explicit prior consent from both the individuals and The CTRL.
11.5 Personal Belongings
All personal items brought into the Studio are the sole responsibility of the Member. The CTRL does not accept liability for loss, damage, or theft of belongings on the premises.
11.6 Dress Code
Members must wear appropriate activewear for Reformer-based Pilates, including fitted tops and leggings or shorts. Grip socks are mandatory for all classes; barefoot participation is not permitted under any circumstances.
Footwear must be removed before entering the Studio space. Grip socks are available for purchase at reception if needed.
12. SAFETY & HYGIENE
12.1 Conduct and Cleanliness
No food, glassware, or crockery is permitted in the Studio or changing areas. Water is permitted.
Animals are not permitted anywhere on the premises, except for registered assistance dogs or pets owned by The CTRL that remain in designated non-training areas (such as reception). Members must not bring personal pets into the Studio under any circumstances.
12.2 Contagious Conditions
Members with contagious foot conditions (e.g. verrucae) must wear suitable coverings and inform Studio staff prior to attending class.
12.3 Emergency Protocols
Members must use the main entrance to enter and exit the Studio. Fire exits are marked and must remain unobstructed. In the event of an emergency, Members must evacuate promptly using the nearest available exit.
12.4 Smoking
Smoking and vaping are strictly prohibited throughout the Studio premises.
12.5 Equipment Use and Member Responsibility
The Studio does not provide formal induction sessions. However, Members are strongly encouraged to begin with a CTRL Foundations class to familiarise themselves with the Reformer and other Studio equipment.
By attending any class, Members confirm they understand how to use the equipment based on teacher guidance and agree to follow all safety instructions provided. The Studio reserves the right to refuse continued participation if a Member is not using equipment safely or is unable to follow instructions.
12.6 Instructor Corrections and Safety Oversight
Instructors may use verbal or light physical cues to support safe alignment. If a Member is unwilling or unable to follow safety instructions or use equipment correctly, the Studio reserves the right to restrict their participation for safety reasons.
13. GENERAL TERMS
13.1 Member Contact Details
It is the Member’s responsibility to inform The CTRL of any changes to contact information. Communications will be deemed received if sent to the most recently provided contact details.
13.2 Right of Refusal
The CTRL reserves the right to deny access to any individual at its sole discretion.
13.3 Transfer of Agreement
The CTRL may assign or transfer its rights and obligations under these Terms without notice.
13.4 Third Party Rights
No third party has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
13.5 Electronic Communication
By providing an email address, Members consent to receive service-related communications electronically, including via email, SMS, or push notification.
13.6 Studio Rules
Members must follow all posted Studio guidelines and comply with instructions from staff to ensure safety, professionalism, and the smooth operation of classes.
13.7 Intellectual Property
All materials provided by The CTRL, whether digital or printed, including but not limited to class content, training guides, visual assets, and branded communications, remain the intellectual property of The CTRL and are protected under UK copyright law.
Unauthorised copying, distribution, or use of these materials may result in legal action, including claims under the Copyright, Designs and Patents Act 1988.
14. FORCE MAJEURE
14.1 Events Beyond Our Control
The CTRL shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any event beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, government restrictions, strikes, power failures, fire, flooding, or other unforeseeable disruptions to operations.
14.2 Service Disruption and Studio Closure
In such circumstances, The CTRL may suspend or cancel sessions, temporarily close the Studio, or otherwise modify its services without liability to Members, provided that it takes reasonable steps to minimise disruption where practicable.
15. WEBSITE USE
By using The CTRL’s website, the User agrees to these Terms. The User must not misuse the website or act in a way that harms its performance or security.
16. INTELLECTUAL PROPERTY
All content on the website, including visuals, text, video, code, and layout, is the intellectual property of The CTRL or licensed third parties. No part of the site may be reproduced or distributed without permission.
17. THIRD PARTY LINKS
The website may include links to external sites for Member convenience. The CTRL is not responsible for the content, accuracy, or privacy practices of third-party websites.
18. WARRANTIES AND WEBSITE DISCLAIMERS
The CTRL does not warrant that information on the website is accurate, current, or complete. The CTRL reserves the right to update or remove content without notice and accepts no liability for any resulting disruption. For details on our liability in connection with your use of the Website, please refer to Clause 19.
19. WEBSITE LIMITATION OF LIABILITY
To the fullest extent permitted by law, The CTRL disclaims liability for:

Events outside its control

Economic or business loss

Data loss or system damage

Indirect or consequential damages
This does not affect liability for death or personal injury caused by negligence.
20. GIFT CARDS
Gift cards must be activated within 3 months of purchase. Once activated, their value will be applied to the Member’s account as credit. Gift cards are non-refundable, non-transferable, and not redeemable for cash.
